General Terms and Conditions

The Terms and conditions in english are just a translation of the german language and are here to help you understand all terms of the contract. Therefore the AGB in german are the valid ones in terms of juridiction.

 

1. General

Between Natasa Litvin, Meidlinger Hauptstraße 5, 1120 Vienna, and the customer, the following general terms and conditions apply exclusively in the version valid at the time of the order. Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity in writing.

By placing your order, you accept the following general terms and conditions.

 

2. Order

The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order under the specified conditions. Descriptions of services in catalogs and on the website are non-binding.

 

By clicking the "Place order" button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after the order has been sent. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days.

 

A note: the goods presented on the website were digitally photographed. There may be slight discrepancies between the depiction of the goods and reality; such deviations do not constitute a defect in the goods ordered.

 

3. Payment Arrangements

The customer can choose from the available payment methods as part of and before completing the ordering process. With all payment methods, payment must be made in advance without deduction.

 

If third-party providers are commissioned to process payments, e.g. Paypal or Stripe. Their general terms and conditions also apply. In the event of default in payment, the customer must pay interest on arrears at a rate of 5 percentage points above the base interest rate. The obligation of the customer to pay interest on arrears does not exclude the assertion of further damages by the seller.

 

If the seller allows payment in advance, the contract is concluded with the provision of bank details and a request for payment. If the payment is not received by the seller within 5 calendar days after the order confirmation has been sent, even after a renewed request, the seller withdraws from the contract with the result that the order is no longer valid and the seller is not obliged to deliver. The order is then completed for the buyer and seller without further consequences. A reservation of the item in the case of advance payments is therefore made for a maximum of 5 calendar days.

 

4. Retention of Title

The goods remain the property of Natasa Litvin until full payment has been made.

 

5. Prices and shipping costs

All prices stated on the seller's website are in euros and include the applicable statutory sales tax.

 

In addition to the stated prices, the seller charges shipping costs for the delivery. The shipping costs are clearly communicated to the buyer during the ordering process.

 

If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects to us immediately.

 

6. Delivery, Availability of Goods

If no copies of the product selected by the customer are available at the time of the customer's order, the seller will inform the customer of this in the order confirmation. If the product is permanently unavailable, the seller will refrain from a declaration of acceptance. A contract is not concluded in this case.

 

If the product specified by the customer in the order is only temporarily unavailable, the seller will also inform the customer of this immediately in the order confirmation.

 

If advance payment has been agreed, delivery will take place after receipt of the invoice amount.

 

7. Warranty and Guarantee

The warranty is determined by legal regulations. There is only a guarantee for the goods delivered by the seller if this was expressly given as part of the ordering process/in the product description.

 

8. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. In order to exercise your right of withdrawal, you must inform Natasa Litvin of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

 

9. Notes on the exclusion of the right of withdrawal

The right of withdrawal does not apply to the delivery of goods that are made to customer specifications or are clearly tailored to personal needs.

 

10. Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. We can refuse the repayment until we have received the goods back.

 

You must return or hand over the goods to Natasa Litvin, Meidlinger Hauptstraße 5, 1120 Vienna without delay and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

 

The consumer bears the costs of the return shipment. The consumer is responsible for the insured shipping of the goods to Natasa Litvin, Meidlinger Hauptstrasse 5, 1120 Vienna.

 

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In addition, you can avoid the obligation to pay compensation for a deterioration caused by the intended use of the item by not using the item as if it were your property and refraining from anything that would impair its value.

 

11. Privacy Policy

The seller processes the customer's personal data for a specific purpose and in accordance with the statutory provisions.

 

The personal data collected during the order (such as name, e-mail address, address, telephone number, date of birth) are used by the seller to fulfill and process the contract. This data will be treated confidentially and will not be passed on to third parties.

 

The customer has the right to request information free of charge about the personal data that the seller has stored about him. In addition, he has the right to correct incorrect data, blocking and deletion of his personal data, provided there is no legal obligation to retain it.

12. Copyright

Sketches, drawings or other documents as well as designs, catalogues, brochures, illustrations and the like always remain our intellectual property.

 

All texts, graphics and the design of our website are for the sole purpose of providing our customers with personal information and are protected by copyright.

 

13. Disclaimer for External Links

Insofar as the Natasa Litvin pages contain links to other pages on the Internet, Natasa Litvin expressly declares that she has no influence whatsoever on the design and content of the linked pages.

 

14. Miscellaneous

The law of the Republic of Austria applies to all contracts and agreements between the customer and Natasa Litvin.

 

The place of jurisdiction for any disputes is Vienna or the place of jurisdiction provided for by the statutory provisions.
